GTC

1. Validity of the GTC

Gelateria di Berna AG (hereinafter referred to as the “Supplier”) provides all deliveries and services on the basis of the following GTC, in the version valid at the time of the order. These GTC are valid for an indefinite period of time, as long as they have not been changed by the parties in written agreement, and are valid for all products and services of the supplier on the online platform www.gelateriadiberna.ch. In all other respects, the provisions of the Swiss Code of Obligations on the contract of sale and other Swiss laws and ordinances shall apply. Should any provision of these GTC be invalid or should there be a gap, the legal validity of the remaining provisions shall remain unaffected. In place of the invalid provisions, a valid provision shall be deemed to have been agreed from the outset which most closely approximates the economic intent of the parties.The same shall apply in the event of a gap. By filling out and sending the order of the corresponding products, the customer accepts these terms and conditions.

2. Offer and conclusion of contract

All offers of the supplier are non-binding. The contract between the customer and the provider is concluded by sending the order in the online store. The confirmation of the supplier is decisive for the scope and execution of the delivery. Immediately after receipt of the order by the provider, the customer receives an order confirmation of receipt of the order, including service content and scope by e-mail. In cases of obvious typing and billing errors, the provider is entitled to withdraw from the contract.

3. Prices and shipping costs

The prices in the online store are not binding and can be adjusted by the provider at any time.

4. Collection and collection period

The collection takes place on the desired date according to the order. For logistical reasons, the ordered Gelato can be stored for a maximum of three days beyond the collection date.

5. Final provisions

The place of jurisdiction is the registered office of the supplier. However, the supplier may also call upon the court at the customer’s place of business. Swiss law is exclusively applicable, even if ordered from abroad or delivered to abroad. The parties shall endeavor to settle any disputes arising from the performance of this contract amicably. These general terms and conditions shall be deemed to be accepted by the Purchaser upon ordering goods. Changes or additions to the general terms and conditions are made exclusively by the supplier and must be made in writing.
